Intoxication and Contract Validity Casinos would not exist if customers didnââ¬â¢t lose money in them year after year. It is a game of statistics and patrons realize more times than not, you will lose. In the case of Terrance Watanabe, he took the concept of losing to a whole other level. After he squandered his entire fortune, he then claimed that because he was intoxicated he should be relieved from the millions he still owed to the casino. Harrahââ¬â¢s was accused of many questionable operating procedures over the course of a year of Mr. Watanabeââ¬â¢s gambling binge. Mr. Wata nabe made the casino millions and expected millions of comps in return. The contract between Mr. Watanabe and the casino showed an agreement, consideration, capacity, and legality. The agreement was that Mr. Watanabe would gamble at the casino for benefits of spending his money. The consideration was the comps and lucrative perks that would be given to continuing to perform gambling large amounts of money. The capacity is the issue in the question of whether he was of sound mind when he entered into the contract. Legality is also an issue based on some of the questionable behaviors of both parties. However, it is perfectly legal for a casino to offer compensation to patrons that they feel are necessary to the success of their business. INTOXICATION At some point in 2006, Mr. Watanabe communicated to the casino and acknowledged the compensation that would be provided for his continued gambling. He was given a constant supply of alcohol and gambled on a continual basis while intoxicated. Staff and management of the casino provided him with alcohol even when friends and family discouraged the drinking. Mr. Watanabe was no doubt intoxicated while gambling at Harrahââ¬â¢s casino.
